Your website probably isn&#8217;t."},"content":{"rendered":"<p>Canadians say they prefer to buy Canadian, and they are backing it up at checkout. CIRA&#8217;s 2026 Canadian Internet Trends report found that 65 per cent of Canadians prefer buying from Canadian retailers when they have the choice, and that 73 per cent are comfortable making a purchase on a Canadian retail website compared to just 42 per cent on an American one.<\/p>\n<p>If you run a Canadian business, that gap is worth money to you. It is also worth checking whether your website is holding up your end of it, because for a lot of Canadian small businesses the Canadian part stops at the logo.<\/p>\n<h2>What the numbers actually say<\/h2>\n<p>CIRA surveyed 2,000 Canadian internet users in March 2026 for its Canadian Internet Trends report. Eighty-six per cent had made an online purchase in the past year. Sixty-five per cent said they prefer Canadian retailers when they have a choice, and 55 per cent gave supporting the Canadian economy and local businesses as the reason.<\/p>\n<p>The number worth paying attention to is the comfort gap: 73 per cent of Canadians are comfortable buying on a Canadian retail site, against 42 per cent on a US one. That is not a sentiment score. That is a conversion signal. Being visibly, verifiably Canadian is a commercial advantage right now, and it is one of the few advantages a small Canadian business holds over a much larger American competitor.<\/p>\n<h2>For most Canadian businesses, &#8220;Canadian&#8221; stops at the storefront<\/h2>\n<p>Here is what a typical Canadian small business website looks like underneath. The domain is a .com registered through an American registrar. The site is on a shared hosting plan from a US-owned provider, running on servers in Virginia or Texas. Email is on Microsoft 365 or Google Workspace. The contact form, the analytics, the CRM and the backups are all American SaaS products. Customer data crosses the border the moment somebody types their name into a form.<\/p>\n<p>None of that appears on the website, and none of it has to. The homepage says proudly Canadian and the infrastructure underneath is entirely American.<\/p>\n<p>This is not usually bad faith. Most business owners have never had a reason to look, and nobody sells hosting by explaining corporate ownership structures. But if you are actively marketing on Buy Canadian, and a customer, a journalist or a procurement officer ever does look, the gap is an awkward one to explain.<\/p>\n<h2>Storing data in Canada is not the same as Canadian data<\/h2>\n<p>The common assumption is that a provider with a Toronto data centre solves this. It does not, at least not by itself.<\/p>\n<p>The US CLOUD Act, passed in 2018, lets American authorities compel a covered entity to produce data in its &#8220;possession, custody or control&#8221;, regardless of where that data physically sits. Covered entities include US companies, foreign companies otherwise subject to US jurisdiction, and foreign subsidiaries where a US parent exercises substantial control.<\/p>\n<p>The test is corporate control, not server location. A company that is wholly Canadian-owned and Canadian-managed generally falls outside the CLOUD Act&#8217;s reach. A Canadian-branded subsidiary of an American parent generally does not, even with every server sitting in Toronto. Being PIPEDA compliant does not block a CLOUD Act order either, because the two laws are answering different questions.<\/p>\n<p>Canada and the United States began negotiating a bilateral agreement under the CLOUD Act framework in March 2022. As of 2026 nothing has been finalized, so the current position is the default one.<\/p>\n<p>Physical location is not purely a legal abstraction either. An AWS region in Bahrain has been unavailable for months after the facility was damaged during the conflict between the US and Iran, which is a blunt reminder that the cloud is a building, in a country, with its own politics and its own risks.<\/p>\n<h2>How to check where your website actually lives<\/h2>\n<p>This takes about ten minutes and you do not need to be technical.<\/p>\n<ul>\n<li><strong>Your domain.<\/strong> Run a WHOIS lookup on your domain name and see who the registrar is and where that company is incorporated. A .ca is a genuine signal here, because CIRA requires anyone holding one to meet Canadian Presence Requirements. A .com tells you nothing either way.<\/li>\n<li><strong>Your hosting.<\/strong> Look up which IP address your domain resolves to, then check where that IP is located and which company owns the network. A Canadian city is a good start, but the more important question is who owns the hosting company itself.<\/li>\n<li><strong>Your email.<\/strong> Check your domain&#8217;s MX records. If they point at Microsoft or Google, your mail is sitting on American infrastructure no matter where your website is hosted.<\/li>\n<li><strong>Everything that touches customer data.<\/strong> Contact forms, e-commerce checkout, analytics, CRM, email marketing, backups. Every one of these is a place where customer data can leave the country, and in our experience this is where most of the leakage actually happens. The website itself is often the least of it.<\/li>\n<\/ul>\n<p>For each one, the question that matters is the same: who ultimately owns this provider, and whose courts can compel them to hand something over?<\/p>\n<h2>The bottom line<\/h2>\n<p>Buy Canadian is not just a sentiment, it is a measurable commercial edge, and 73 per cent against 42 per cent is not a rounding error. But it is a claim that should be able to survive somebody checking it. If your marketing says Canadian, then the domain, the hosting, the email and the customer data should all be able to back that up.<\/p>\n<p>Most Canadian small business websites cannot back it up today. The useful part is that fixing it is generally far less disruptive than owners expect, and it is the kind of thing that is much easier to do deliberately now than to explain later.<\/p>\n<hr \/>\n<p>Full disclosure, since this is a hosting provider&#8217;s blog: we are CanSpace, a Canadian-incorporated company with all of our servers in Canada and Canadian-staffed support.
